The Tax-Deferred Exchange provides a means of using increased value in business or investment properties to purchase other real estate. It is a legal means to defer paying income taxes on gains realized from the sale of real estate through re-investing the gains.
The first Tax-Deferred Exchange Laws were enacted and became part of the Internal Revenue Code in 1921. A very important ruling was made in 1979; the Starker Case Decision upheld delayed exchanges. Thus, the transfer of property does not need occur at the same time; one property could be "sold" and escrow closed one day and the replacement property being acquired "purchased" and escrow closed at a later date. NOTE: There are IRS regulations that must be strictly followed to preserve the right to defer tax gains. Prior to doing an exchange, work with someone knowledgeable on the subject whom can advise you on the requirements necessary to qualify for the tax deferment. You CANNOT simply "sell" one property and "buy" another.
What investors have to say about Mark Redfield P.C. CRS,GRI
"We were very pleased with your handling of our 1031 Exchange real estate transaction. Your marketing of our three investment properties enabled us to achieve a maximun return from them. Your help in identifying the larger replacement property that we purchased fulfilled our investment criteria. Your timing of the close of our sales and the close of our purchase (5 days!) assured that the disruption of cash flow from our real estate investments was an absolute minimum. Please feel free to use us should you need a reference to your other clientele." "In 1990 I started investing in real estate in Salem, OR. Early in my search for investment properties I met Mark Redfield, who has since become a close adviser in real estate transactions -- both investments and personal living accommodations. "Within a short period of time after meeting Mark we closed transactions on two investments properties. Between 1990-1992, I consulted with Mark on a number of additional investments. In 1995 Mark worked closely with me in selling two duplexes and transferring the equity through a 1031 exchange into an apartment complex. This was a complex transaction as the exchange property was in receivership. Mark worked closely with the many parties involved, completing the exchange in an efficient and timely manner. Mark's professional guidance in the selection of an exchange facilitator, inspectors and property manager was invaluable to me as an investor. "Mark has also assisted me in locating agents in Portland and in Sunriver, OR, for other properties I was marketing. In both cases it was not just the normal referral but Mark personally went to both locations and interviewed several agents to determine which agent was most suitable for accomplishing a professional marketing strategy. He also provided counsel as offers were negotiated and transactions closed.
"Whenever I have had need for professional advice, I have been confident I could turn to
Mark and receive his honest professional evaluation. I whole heartedly recommend Mark
as being a dependable, honest and a thoroughly professional realtor, whether your real
estate goals are as an investor or involve your personal home."
